Will public funds be used to pay for abortions?

No. The ACA forbids the use of public funds for abortions.

A federal judge in Ohio said on August 1, 2011 that, "...the Affordable Care Act does not provide for taxpayer funded abortion. That is a fact and it is clear on its face." (List v. Driehaus, 1:2010cv00720, S.D. Ohio 2011).

The law does allow private health insurance plans to choose whether to offer abortion coverage. It also lets States decide whether or not health plans on their Exchanges can offer this coverage.

Even if a health plan includes abortion coverage, no federal funds can pay for abortions.

People receiving subsidies to buy health insurance on a state exchange may not use it to pay for abortion insurance.

The ACA does not change federal law that prohibits public insurance like Medicaid from paying for abortions except in the case of incest, rape or to save the life of the mother.
